The Race Relations (Amendment) Act 2000 and the Disability Discrimination Act 1995 both state that the way in which goods and services are delivered must not have an unequal impact on any particular community - and this extends to the suppliers and subcontractors any public sector organisation uses. Where any of the public sector organisations' functions is carried out by an external supplier, it also remains responsible for meeting the duty through the supply chain.  

 

It is a requirement of the (Local Authority) Equality Standard that equality-related targets and objectives are set for suppliers and subcontractors, as well as systems to monitor progress towards those targets.   If the suppliers are not meeting those standards and targets; for example to have equalities monitoring in place or develop work in consultation with communities (to ensure services are appropriate and fit for purpose) then the public sector organisation will be held to account and may face prosecution.   Therefore, it is essential that all contractors through the entire supply chain are able to evidence their compliance and carry out their work in accordance with the legislation.
